A case is presented in which the therapeutic interests of the patient conflict with the safety of a community, and in which the surrogate decision maker has very limited knowledge of or concern for the patient’s preferences. The substituted judgment and best interest (or rational patient) standards for surrogate decision making are problematic in this case. It is argued that the interests of even those outside the family ought to be taken seriously when making decisions about such cases, and it (...) is proposed that clinical ethics committees could play a new role here. This case also illustrates the difficulties of making decisions regarding the treatment of a very unlikable patient. (shrink)

This Element explores what it means for two theories in physics to be equivalent, and what lessons can be drawn about their structure as a result. It does so through a twofold approach. When it comes to scientific explanation, our parsimonious tendencies mean that we focus almost exclusively on those dispositions whose manifestations result in some sort of change – changes in properties, locations, velocities and so on. Following this tendency, our notion of causation is one that is inherently dynamic, as if the maintenance of the status quo were merely a given. Contrary to this position, I argue that a complete concept of causation must also account for dispositions whose manifestations involve no (...) changes at all, and that a causal theory that fails to include these ‘static’ dispositions alongside the dynamic ones renders static occurrences miraculous. I present a general theory of abstraction operators which treats them as variable-binding term- forming operators, and provides a reasonably uniform treatment for definite descriptions, set abstracts, natural number abstraction, and real number abstraction. This minimizing, extensional and relational theory reveals a striking similarity between definite descriptions and set abstracts, and provides a clear rationale for the claim that there is a logic of sets (which is ontologically non- committal). The theory also treats both natural and real numbers as answering (...) to a two-fold process of abstraction. The first step, of conceptual abstraction, yields the object occupying a particular position within an ordering of a certain kind. The second step, of objectual abstraction, yields the number sui generis, as the position itself within any ordering of the kind in question. (shrink)

Many philosophers have claimed that “belief aims at the truth”. But is there any interpretation of this claim on which it counts as true? According to some philosophers, the best interpretation of the claim takes it as the normative thesis that belief is subject to a truth-norm. The goal of this essay is to clarify this normative interpretation of the claim. First, the claim can be developed so that it applies to partial beliefs as well as to flat-out full beliefs. (...) Secondly, an answer is given to the objection that has been raised against the claim that belief is subject to a truth-norm of this sort by Krister Bykvist and Anandi Hattiangadi; responding to this objection will involve careful reflection on the structure of normative concepts, and of how these normative concepts apply to belief. Many philosophers have thought that colours or flavours or values are in some way less objective than shape or mass or motion. This paper explores the approach to capturing this thought that is based on the idea of ‘ response-dependence ’. First, it is argued that the conceptions of response-dependence developed by Mark Johnston, Philip Pettit and Crispin Wright fail to capture this thought adequately. Then, the rest of the paper proposes an alternative conception, based in part on Kit Fine's (...) notion of " essence ", which looks more likely to succeed in capturing the thought adequately. Comparison is fundamental to the practice and subject-matter of philosophy, but has received scant attention by philosophers. This is even so in “comparative philosophy,” which literally distinguishes itself from other philosophy by being “comparative.” In this article, the need for a philosophy of comparison is suggested. What we compare with what, and in what respect it is done, poses a series of intriguing and intricate questions. In Part One, I offer a problematization of the tertium comparationis (the third of comparison) (...) by examining conceptualizations of similarity, family resemblance, and analogy, which it is sometimes argued can do without a tertium comparationis. In Part Two, I argue that a third of comparison is already required to determine what is to be compared, and insofar as that determination precedes the comparison that tertium may be called “pre-comparative.” This leads me to argue against incomparability and to show how anything can indeed be compared to anything. In Part Three, I relate my arguments to what is today commonly labelled “comparative philosophy.” Finally, I raise some questions of ontology and politics in order to demonstrate the relevance of a philosophy of comparison. It has long been disputed whether Kant's transcendental idealism requires two worlds ? one of appearances and one of things in themselves ? or only one. The one-world view must be wrong if it claims that individual spatio-temporal things can be identified with particular things in themselves, and if it fails to take seriously the doctrine of double affection; versions that insist on one world, without making claims about the identity of individual things, cannot say in what way the world (...) as we know it and the world of things in themselves can be ?the same?. The two-world view must be wrong if it denies Kant's empirical realism, or offers a phenomenalist interpretation of it. On moral grounds Kant ?identifies? each human person with a particular thing in itself, but the relationship here cannot be strict identity; instead its closeness may warrant regarding the two distinct entities as part of a composite whole. Perhaps up to the first edition of the Critique, Kant thought that empirical knowledge required a particular kind of close correspondence between appearances and things in themselves, one that would make it appropriate to speak of composite wholes here also. By the time of the second edition, he saw that there could be no good grounds for thinking that. In this respect something a bit like the one-world theory might make more sense for the first edition than for the second; but in both cases there is room to speak of two worlds as well. Talk of the number of worlds is metaphorical, and both metaphors have their dangers. (shrink)

The Search for the Legacy of the USPHS Syphilis Study at Tuskegee is a collection of essays from experts in a variety of fields seeking to redefine the legacy of the infamous Tuskegee Syphilis Study. The essayists place the legacy of the study within the evolution of racial and ethnic relations in the United States. Contributors include two leading historians on the study, two former United States Surgeons General, and other prominent scholars from a wide range of fields.

Any physical explanation of consciousness seems to leave unresolved the ‘explanatory gap': Isn't it conceivable that all the elements in that explanation could occur, with the same information processing outcomes as in a conscious process, but in the absence of consciousness? E.g. any digital computational process could occur in the absence of consciousness. To resolve this dilemma, we propose a biological-process-oriented physiological- phenomenological characterization of consciousness that addresses three ‘paradoxical’ qualities seemingly incompatible with the empirical realm: The dual location of (...) phenomenal properties ‘out there’ yet ‘in here’ in consciousness; the mysterious ‘thickness’ of the specious present; the feeling of ‘free agency', that we can voluntarily direct our actions, including the act of conscious attention, while at the same time attention and the emotions that direct it seem responsive to physiological substrates with physical causes. These paradoxes are then resolved by relating three elements of consciousness: organismically interested anticipation; sensory and proprioceptive imagery generated by the interested anticipation rather than by sensory input; resonating of these activities with activity stimulated by sensory data, where the interested anticipation precedes the processing of the input. Each of these elements is bridged to physiological processes such that, if they occur in a certain relation to each other, we can understand why they would inevitably be accompanied by the corresponding elements of conscious experience. This paper starts by giving an interpretation of the notorious question "Why be moral?" Then, to answer that question, it develops an account of why some moral reasons -- specifically, the moral reasons that ground moral requirements -- are sufficiently weighty that they outweigh all countervailing reasons for action.

In this article I examine what happens to the “I” when the other disappears. I elucidate the relationship between ontic – relational ties to specific others – and ontological relationality – the fundamental relationality that facilitates the very existence of the “I.” The loss of an ontic relationality, I contend, ensures that the “I” can never be the same as it was prior to the loss. But the disappearance of an ontic relationality also accentuates that the “I” cannot disavow its (...) ontological relationality, despite the pain and suffering brought about by the loss of a specific other. I argue that exposure to this ontological relationality, through the deprivation of an ontic one, offers us the opportunity to re-think habituated and potentially damaging forms of relationality, particularly in an age when neoliberal rationality encourages us to turn away from the other and to seek shelter in the self. To explicate the chiastic relationship between ontic and ontological relationality, I draw on Maurice Merleau-Ponty’s concept of the “hinge,” Judith Butler’s work on grief and mourning, and Emmanuel Levinas’s notion of the “face.” By looking specifically at remembrance campaigns for victims of forced disappearance – particularly in Guatemala and Argentina – I show how faces of the disappeared continue to haunt the political present in ways that refuse the fantasy of a return to a former order. In doing so, these campaigns keep exposing us to the ontological relationality that underpins all human life, encouraging us to find new ways of relating that transcend our habituated and repetitive relational behaviours. This exposure, I argue, illustrates that no amount of self-sufficiency allows us to escape the ontological necessity of relationality. The disappearance of the other, any other, discloses the fraudulent anti-relationality of the neoliberal era by revealing the ties that connect beings together. This disclosure, I conclude, constitutes the importance of the relationality of disappearance. -/- . (shrink)

Criticizing mainstream norm, practice and realist theory, Jason Ralph offers a 'Pragmatic Constructivist' theory of learning, which is then used to assess international society's problem-solving capacities.

From early on, comparative philosophy has had on offer a high variety of goals, approaches and methodologies. Such high variety is still today a trademark of the discipline, and it is not uncommon of representatives of one camp in comparative philosophy to think of those in other camps as not really being about ‘comparative philosophy’. Much of the disagreement arguably has to do with methodological problems related to the concept of comparison and with the widely prevailing but unwarranted assumption that (...) comparative philosophy should be about comparing ‘culturally different philosophies’. This paper seeks to problematize this assumption by clarifying conceptually the notions of ‘comparative philosophy’ and of ‘comparison’, by showing the prevalence of the assumption in recent second-order discussions of methodology in comparative philosophy and its restraining implications in a randomly selected contribution of ‘Chinese philosophy’. At the end, a rallying call for a (self-)critical comparative philosophy is issued. (shrink)
